In 2009, the Coalition filed a lawsuit against the City of Stockton and San Joaquin County alleging that the stormwater sewer system violated the Clean Water Act and degraded water quality to a degree that harmed endangered species in the Delta in violation of the ESA. The legal action targeted the municipal storm sewer system operated by the City and County, which has discharged pollutants in violation of applicable permits limits resulting in degraded water quality in the Delta and adverse impacts on fish species that reside in the Delta, including delta smelt and salmon.

In September 2015, the Coalition settled the lawsuit. Pursuant to the terms of the settlement, the City and County are required, among other things, to implement a water quality and monitoring program, as well as improve pollution prevention at municipal facilities to reduce contaminants in stormwater discharges.

The Coalition’s efforts will ensure that the City and County do all they can to reduce harm to the estuary caused by stormwater discharges.
